2. התקנון מנוסח בלשון זכר מטעמי נוחות בלבד, אך פונה לנשים וגברים כאחד.

3. עצם הגלישה באתר ו/או ביצוע פעולה במסגרתו מהווים הסכמה מלאה לכל התנאים המפורטים להלן.

זכאות לשימוש

4. כל אדם מעל גיל 18 הכשיר משפטית רשאי לעשות שימוש באתר, וכן תאגיד רשום כחוק.

5. קטינים מתחת לגיל 18 רשאים לבצע פעולות באתר רק בכפוף להסכמה ואישור מפורש של הורה או אפוטרופוס. האחריות לכך מוטלת על האפוטרופוסים בלבד.

שימוש הוגן ותכני האתר

6. חל איסור להשתמש באתר לכל מטרה בלתי חוקית או מזיקה.

7. אין להעתיק, לשכפל, להפיץ או לעשות שימוש מסחרי בתכני האתר (כולל טקסטים, עיצובים, תמונות ולוגואים) ללא קבלת הסכמה מראש ובכתב מהחברה.

8. החברה רשאית לעדכן, לשנות או להסיר תכנים ושירותים המוצגים באתר בכל עת.

מידע על מוצרים, מלאי ומחירים

9. כלל הפריטים באתר מוצגים בכפוף למלאי הקיים במחסני החברה.

10. התמונות נועדו להמחשה בלבד וייתכנו הבדלים בין מראה המוצר באתר לבין המוצר בפועל.

11. החברה שומרת לעצמה את הזכות לשנות מחירים, מבצעים או תיאורי מוצרים בכל עת וללא הודעה מוקדמת.

12. המחירים כוללים מע"מ כחוק, אלא אם נכתב אחרת, ואינם כוללים עלויות משלוח – אלא אם צוין במפורש.

הרשמה וביצוע הזמנה

13. רכישה באתר יכולה להתבצע כאורח או באמצעות פתיחת חשבון משתמש.

14. בעת ההזמנה נדרש למסור פרטים נכונים, מלאים ועדכניים. אחריות לאי-מסירת פרטים מדויקים תחול על הלקוח/ה בלבד.

15. עסקה תיחשב כמושלמת רק לאחר קבלת אישור עסקה מחברת האשראי או שירות הסליקה.

16. במקרה של טעות בפרטי ההזמנה או אמצעי התשלום – ההזמנה עלולה להתבטל, וחיובים נוספים עשויים לחול.

משלוחים ואספקה

17. המשלוחים יסופקו באמצעות חברת שליחויות חיצונית.

18. החברה לא תישא באחריות לעיכובים הנובעים מגורמים חיצוניים שאינם בשליטתה, כגון עיכובי חברת שליחויות, כוח עליון, מזג אוויר קיצוני או שביתות וגם מסיבות של פרטים שגויים, סירוב קבלת הזנה, אי נוכחות בזמן אספקת המשלוח.

ביטול, החזרות והחלפות

19. ביטול עסקה יתבצע בהתאם לחוק הגנת הצרכן.

20. ניתן להחזיר או להחליף מוצר בתוך 14 יום מקבלת ההזמנה, כל עוד המוצר לא נעשה בו שימוש, נמצא באריזתו המקורית וכולל תגיות שלמות.

21. ברכישות שבמבצעי סוף עונה/SALE, פרק הזמן להחזרה יעמוד על 2 ימי עסקים בלבד.

22. החזר כספי יועבר לאמצעי התשלום המקורי תוך 7 ימי עסקים, בניכוי דמי ביטול בשיעור של עד 5% או 100 ₪ – הנמוך מביניהם.

23. מוצרים שיוצרו בהתאמה אישית או בהזמנה מיוחדת אינם ניתנים להחזרה, למעט מקרים של פגם במוצר.

אחריות ושיפוי

24. המוצרים נמכרים כפי שהם (AS IS), בכפוף לאחריות היצרן או כפי שמופיע במדיניות החברה.

25. החברה לא תישא באחריות לכל נזק עקיף או תוצאתי שייגרם עקב שימוש במוצר או באתר.

26. המשתמש/ת מתחייב/ת לשפות את החברה, עובדיה ונציגיה בגין כל נזק או הוצאה שייגרמו עקב שימוש בלתי חוקי או הפרת תנאי התקנון.

פרטיות ואבטחת מידע

27. המידע הנמסר על ידי המשתמש/ת ישמש לצורך תפעול ההזמנה, שירות לקוחות, ושיווק – בכפוף להסכמת הלקוח/ה.

28. החברה מתחייבת שלא למסור מידע אישי לצד שלישי אלא אם נדרשת לכך על פי דין.

29. ננקטים אמצעי אבטחה סבירים ומקובלים, אך החברה אינה יכולה להבטיח הגנה מוחלטת מפני פריצות או חשיפה לא מורשית.

קניין רוחני

30. כל זכויות היוצרים והקניין הרוחני באתר – כולל העיצוב, המידע, הלוגו, התמונות, הטקסטים והקוד – שייכות לחברה בלבד.

31. חל איסור לעשות שימוש מסחרי או פרסומי כלשהו במידע זה ללא קבלת אישור מפורש בכתב.

Cancellations, Returns, and Exchanges

  2.  Products may be returned or exchanged within 14 days of receipt if unused, in their original packaging, and with intact tags.

  3.  For end-of-season or SALE purchases, the return period is 2 business days only.

  4.  Refunds will be issued to the original payment method within 7 business days, minus a cancellation fee of up to 5% or ₪100 (the lower of the two).

  5.  Custom-made or special-order products are not returnable except in cases of product defect.

 

 

Liability and Indemnification

  1. Products are sold “AS IS,” subject to the manufacturer’s warranty or as stated in the company’s policy.
